Intellectual property

All photographs, videos, designs, graphics, text, and other content on our websites and in our delivered galleries are the copyrighted property of EverNorth Media / Ashley Aragon pursuant to 17 U.S.C. § 201(a). All rights reserved.

You may not:

Reproduce, redistribute, or republish any image or content from our website or galleries without written permission.

Remove, alter, or obscure any watermark or branding from delivered images.

Use any image for commercial purposes (sponsor content, brand promotion, resale, stock photography, or business marketing) without purchasing a Commercial Use License, as outlined in each service’s contract.

Re-edit, filter, or substantially alter purchased or delivered images, except for minor cropping and brightness adjustments for social-media posting.

Scrape, mine, or harvest content from our websites or galleries.

Contact us through our forms and email

Book services and purchase galleries or prints

Share purchased images for personal use, with proper tagging (@evernorthmedia.ak required)

Limitation of liability

To the maximum extent permitted by law, EverNorth Media is not liable for indirect, incidental, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim is limited to the total fees you paid for the relevant service.

Governing law

These Terms are governed by the laws of the State of Alaska. Any disputes arising under these Terms shall be resolved in the courts of the State of Alaska, Kenai Peninsula Borough.

Privacy Policy

What we collect

When you book a service, sign up for Get Tagged, fill out a contact form, or purchase digital downloads, we may collect the following:

Your name, email address, and phone number

Mailing address (for shipped prints, when applicable)

Social media handles (Instagram, TikTok, Facebook, Threads, and other platforms)

Photographs and images of you, your minor children (with parental consent), and your equipment captured during a booked service or event

Race/event information (race number, class, bike brand, when applicable)

Payment information processed by our third-party vendors (we do not store full payment details ourselves)

How we use this information

We use the information you provide to:

Deliver photography services, image galleries, and print orders you’ve booked or purchased

Send you booking confirmations, gallery access links, and event-related communications

Tag you on social media when you’ve opted in via the Get Tagged form or a Race Day Model Release Process

payments through our booking and gallery platforms

Respond to inquiries and customer-service requests

We will never sell your personal information to third parties.

Third-party services

we use We use several third-party platforms to operate our business. By using our site or booking a service, your information may be shared with these vendors under their own privacy policies:

Squarespace — website hosting, contact forms, and form submissions (squarespace.com/privacy)

HoneyBook — booking, contracts, invoices, and payments (honeybook.com/privacy)

Pixieset — image galleries, digital downloads, and print sales (pixieset.com/privacy)

Stripe — payment processing on behalf of Pixieset and other vendors (stripe.com/privacy)

We are not responsible for the privacy practices of these vendors. Please review their policies if you have questions about how they handle your data.

Cookies and analytics

Our website uses cookies to function properly and to gather basic analytics about site usage. Cookies are small text files stored in your browser. You can disable cookies through your browser settings, but some site features may not work correctly without them.

Children’s privacy

We do not knowingly collect personal information from anyone under 13 without parental consent. For riders under 18, all booking and Get Tagged information must be submitted by a parent or legal guardian using the appropriate Parent / Guardian form, which includes consent to collect and use the minor’s information for the booked service or opt-in marketing release.

Opt out of any marketing or promotional use of your images

Image Use Notice

Each paid photography service has its own contract that governs how images from that service can be used. The full terms — including Commercial Use Licenses, watermark policies, and model release elections — are detailed in each service’s signed agreement.

For the Get Tagged sign-up (free, opt-in service): your social handles and consent decision are stored on file. We will tag you using the handles you provided when sharing your images on social media. You can opt out at any time by emailingevernorthmedia.ak@gmail.com.

If no model release election is made on a contract or form, the default is OPT OUT. Your images will not be used for marketing, portfolio, or promotional purposes.

Refund Policy

Refund terms vary by service. The summary below covers our default policies; specific refund rules for each booked service are in that service’s contract.

Race Day Pre-Books (City Race + State Race)

Deposit refundable if you cancel with 48+ hours notice before the event

Deposit forfeited if you cancel with less than 48 hours notice or no-show

Full refund (including deposit) if your rider can’t compete due to injury, mechanical issue, or other circumstance preventing participation

Partial refund logic applies to State Race weekends if you complete one day but miss the second See each contract for full detail

Back to the Track Mini Sessions

Deposit refundable with 48+ hour notice for rescheduling or cancellation

Deposit forfeited for cancellations under 48 hours or no-shows

Severe weather triggers a full reschedule at no charge OR a full refund

Post-Race Digital Downloads (Pixieset galleries)

All digital download purchases are final. Files deliver instantly and cannot be returned. If you experience a technical issue with a download, contact us within 48 hours and we will resolve the issue or re-issue the download link.

Fine Art Prints

All fine art print sales are final. No refunds, no returns. Damaged-in-shipment items may be replaced at the Photographer’s discretion. Contact us within 7 days of receipt with photos of the damage.

Get Tagged

Get Tagged is free. There is no charge and therefore no refund. Custom Services / Book a Shoot Refund terms are specified in the Custom Services Contract you sign before each booking.

DMCA / Copyright Infringement

If you believe content on our website infringes a copyright you own, please contact us with a Digital Millennium Copyright Act (DMCA) notice including:

Your name, address, telephone number, and email.

A description of the copyrighted work you claim has been infringed

The URL or specific location of the allegedly infringing material on our site

A statement that you have a good-faith belief that use of the material is unauthorized

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

Your physical or electronic signature
